    This brief comment in support of the proposed amendment to Rule 6.3, Arizona Rules of Criminal Procedure is submitted on behalf of the State Capital Post Conviction Public Defender. We believe the proposed amendment will help expedite the post conviction process. This proposal obligates prior counsel to ensure the availability of the entirety of the case file to successor counsel. In our brief history, we have obtained files from prior counsel which were not complete, files which did not contain all of the tape recorded interviews or police reports, and a file which had been stored in a basement which flooded, making much of the file unusable. We therefore support this proposal.
