    I am concerned that the proposed change to applicant records access (123(e)(2)) could lead to more litigation. If the amendment is adopted, an unsuccessful candidate for a court job who believes that he or she was the victim of some kind of discriminatory hiring decision might be forced to file a lawsuit to gain access to even the most basic information in the recruitment file. Although it may be a good policy to deny access to the general public to such files, the court should consider making a limited exception for the applicants themselves to get some discrete and basic information (e.g. who was on a hiring committee) to avoid unnecessary litigation.
