    I believe the amendment to Rule 43(D)(3) is too broadly crafted and would result in copies of nearly all filings to be provided to the judge, including discovery and notices thereof, completion of parenting classes, changes of address and/or employment for child support purposes, etc. Copies should only go to the judge if a party is filing a petition or motion or otherwise seeks relief. With nearly 400 cases, processing mail that requires no judicial intervention would be extremely burdensome. I do believe an amendment is required because many parties fail to copy the judge with petitions and motions and are unaware of the local rule that would require copies to be so filed. I just worry about the language as written. Thank you for your consideration of this comment.

    This comment is limited to a technical correction in the proposed language of Rule 43(G)(2) related to sensitive data. The phrase, “Confidential Information Form” should be replaced with the phrase, “Confidential Sensitive Data Form” in the final draft to match the phrasing in the rest of the rules.

    The Clerk’s Office in Maricopa County recently consolidated operations involving default decrees and judgments. The newly implemented process aligns with the comment and recommendation submitted by the Arizona Association of Superior Court Clerks (AASCC). Based on these changes, the Clerk of the Superior Court in Maricopa County withdraws its individual comment to proposed Rule 44(B)(4) and supports the AASCC’s comment as filed on May 16, 2008.
