The comment indicates that the Committee proposes edits to the revisions presented by the “Alternative Proposal” addressing Rules 36(e), 36(f) and 37(c). In order to provide the most informed comments and recommendations, the Committee reviewed attorney admissions rules in other jurisdictions. Additionally, the Committee respectfully requests that Rule 37(c) remain as it is with the exception of the addition of the Committee on Examinations to the list of entities the custodian of record may disclose to. Proposed changes also reflect anticipated revisions to Rules 36(e) and 36(f).

The Comment indicates that the Committee on Examinations opposes proposed revisions, as presented by the Alternative Proposal to R-10-0019, but joins with the Committee on Character and Fitness in proposing alternative language to Rule 37(c) as indicated in the attachment below. The proposed revision to Rule 37(c) would not change the various entities with which confidential information may be shared, but clarifies that records may be shared with committee members and regulatory boards for good cause shown.
