    The Arizona Association of Superior Court Clerks submits that the electronic signature requirements proposed in R11-0011 for Civil Rule 11(a)(2) conflict with the electronic signature format proposed in R11-0012 for Supreme Court Rule 124(g)(1). The Clerks take no position on which electronic signature standard should prevail, but request clarification in the final rules as to the proper format for an electronically signed document.

    I propose the following wording be added to Rule 124 to improve the overall flexibility and efficiency of electronic filings and to conform the rules to the actual data management and retrieval process. These changes would not diminish the rights of parties and would promote best practices in limited courts especially where case volume is high.

    1. RULE 124 (b) Electronic Filing Authorized. ADD this wording: "FILINGS ARE ALSO AUTHORIZED BY ANY ELECTRONIC FILING APPLICATION APPROVED BY THE COURT." The addition of this wording would authorize e-filing in city courts that are not yet Turbo Courts or would not necessarily use Turbo Court applications.

    2. RULE 124 (e) (1) Official Record. Add a new sentence to the definition of "official record". ADD: " OFFICIAL RECORD MAY ALSO INCLUDE AN ABSTRACT OF DATA OR OTHER DISPLAY OF ELECTRONIC DATA CONSTITUTING A CRIMINAL OR CIVIL OFFENSE OR A PART THEREOF."

    It is respectfully submitted that locating these definitions in Rule 124, which deals with e-filing, is a proper location for same and will supply definitional meanings for Traffic and Boating violations and Uniform Citation violations. It will save the limited courts time and paperwork and move the courts away from original documents or reproductions.
