    Petition to Amend Rule 10, Arizona Rules of Civil Procedure; Rule 110, Justice Court Rules of Civil Procedure

    Would allow the court to substitute a fictitiously named defendant's true name after judgment, conditioned on findings that the defendant was properly served and was reasonably identified so that the defendant knew or should have known of the proceeding

    I support these changes. Having the ability to add a previously unknown spouse would facilitate and compliment the joinder requirement of ARS 25-215. Currently, judgment creditors are exposed to potential liability when enforcing judgments against individuals who are or who later become married and that marriage is not known by the judgment creditor.
