Whether the party who is ultimately awarded legal decision-making must be the party who originally filed the petition to modify legal decision-making under Arizona Rule of Family Law Procedure 91.

Once a party has filed a petition to modify legal decision-making in accordance with Rule 91, the superior court may award either party legal decision-making regardless of whether or not that party filed the initial petition.

1.    Whether the trial court lacked jurisdiction to enter a temporary order granting petitioning grandparents legal decision-making and parenting time over their grandchildren when the grandparents' petition and supporting affidavit satisfied A.R.S. § 25–409 by alleging that they stood in loco parentis with the grandchildren and that allowing the grandchildren to stay in their mother’s care would be significantly detrimental.

 

2.    Whether the trial court’s application of a best interests standard in making its temporary order under A.R.S. § 25–409 was erroneous.

1. Whether the superior court erred by concluding that A.R.S. Section 28-672, which creates the Class 3 misdemeanor offense of causing a person serious physical injury from an accident that results from committing certain traffic violations, is a strict liability offense and that the State need not prove that the defendant acted with a culpable mental state when he committed the misdemeanor.

2. Whether the superior court erred by determining that a violation of A.R.S. Section 28-672 was not a jury eligible offense under either Article 2 Section 23 or 24 of the Arizona Constitution as set forth in Derendal v. Griffith, 209 Ariz. 416, 104 P.3d 147 (2005).
