A Public Meeting of the Corrections Officer Retirement Plan Local Board for the Judiciary was convened Tuesday, March 5, 2024, at 10:00 a.m., via Zoom, Arizona State Courts Building, 1501 West Washington Street, Phoenix, Arizona.

 

Board Members Present by Conference/Video Call: Kevin Kluge (Chair); Jason Hathcock; Mark Smalley; Jennifer Fish

February 6, 2024 – Public Meeting Minutes

 

MOTION: Mark Smalley moved to approve the public meeting minutes of the February 6, 2024, meeting. The motion was seconded by Jason Hathcockand passed unanimously. The minutes stand approved. CORP 2024-06 

 

Request to Remain in ASRS – Lynna Mros:

 

The Board received a request dated February 9, 2024, from Lynna Mros to remain in the Arizona State Retirement System (ASRS) pursuant to A.R.S. § 38-891.F.

 

Ms. Mros was previously employed with the Cochise County Superior Court from July 8, 2023, until November 11, 2023, as a Program Manager. She also held additional ASRS-participating positions dating back to October 13, 2001. Ms. Mros became a full-time Juvenile Detention Officer with the Cochise County Superior Court Juvenile Detention Department on November 13, 2023. Her request indicates that she has 7.49 years of credited service with ASRS.

 

Copies of A.R.S. § 38-891.F. and Ms. Mros’s current position description were provided to the Board.

 

The Board Secretary noted that Ms. Mros appeared to have met the eligibility requirement of a minimum of five years of credited service under ASRS and filed her request with the Local Board within ninety days of accepting a CORP-designated position.

 

MOTION: Jason Hathcock moved to approve the request by Lynna Mros to remain in ASRS, as it appeared Ms. Mros had met the eligibility requirements of a minimum of five years of service credited under ASRS and filed her request with the Local Board within ninety days of accepting a CORP-designated position. The Motion was seconded by Mark Smalley and passed unanimously. CORP 2024-07

 

Notice of Retiree Return to Work – Richard Lopez

 

The Board received a Notice of Retiree Return to Work from the Maricopa County Judicial Branch for Richard Lopez, indicating that Mr. Lopez retired from the Maricopa County Sheriff’s Office in April 2020, with an effective CORP retirement date of May 1, 2020. He had since accepted an employment offer with the Maricopa County Judicial Branch and returned to work on February 5, 2024, in a non-CORP-designated position as a Background Investigator.

 

Copies of A.R.S. § 38-884.N-O. and Mr. Lopez’s current position description were provided to the Board.

 

The Board Secretary noted that Mr. Lopez appeared eligible to continue to receive a CORP pension because he returned to work in a non-CORP-designated position after retirement.

 

MOTION: Jennifer Fish moved that the Board received a Notice of Retiree Return to Work for Richard Lopez and found that (1) Mr. Lopez is eligible to receive a CORP pension. (2) Mr. Lopez’s employer, Maricopa County Judicial Branch, is not responsible for paying the CORP alternate contribution rate on his behalf since he returned to work in a non-CORP-designated position. The motion was seconded by Jason Hathcock and passed unanimously. CORP 2024-08

MOTION: Jennifer Fish moved to approve the 32 applicants listed on the agenda for this meeting for membership in CORP pursuant to A.R.S. § 38-893.D. and to note for the record that the physical examinations for Cantrel Neilsen, Shelby Ward, Anthony Arias, Brian Begay, Keesha Brooks, Carl Stine, Jeffrey Milton, Christian Alvarado, Hope Thatcher, Hillel Watkins, and Patrick Corridan identified a physical or mental condition or injury that existed or occurred before their dates of membership in the plan. The motion was seconded by Mark Smalley and passed unanimously. CORP 2024-09

 

Future Agenda Items:

 

The Chair notified the Board that he would not attend the April 2, 2024, Local Board meeting and requested a volunteer to chair the meeting in his absence. Jason Hathcock volunteered to chair the April 2, 2024, meeting.

 

The Board Secretary informed the Board that disability applicant #19-02, Matthew Baack, was tentatively scheduled for an Independent Medical Examination (IME) on April 5, 2024, to reevaluate his disabling condition.

 

The Chair directed the Board Secretary to secure the attendance of Liana Garcia, Administrative Office of the Courts (AOC) Government Affairs Director, at the April 2, 2024, and May 7, 2024, Local Board meetings to deliver an update on legislation changes expected to impact CORP.
