    Would adopt Supreme Court Rule 124 in response to SB1265 and allow for electronic signatures on e-filed documents that require a sworn written declaration, verification, certificate, statement, oath, or affidavit.

    Would adopt a new Rule 124 of the Rules of the Supreme Court of Arizona creating a uniform provision for the creation and acceptance of electronic signatures on electronically filed documents.

    Comments must be submitted on or before Monday, May 2, 2022.
    Any reply by a petitioner must be submitted on or before Wednesday, June 1, 2022.

    Amended petition to be filed on or before May 1, 2023. (Filed: March 23, 2023)
    Comments due on or before June 1, 2023.
    Petitioner's reply due on or before June 15, 2023.

    On February 9, 2022, the Family Court Improvement Committee discussed the similarities between this Petition and R-21-0040, a Petition filed by this committee. Understanding the difficulty inherent in creating a rule suitable for all case types, the committee moved to support this Petition regarding electronic signatures with a recommendation that the amendments enumerated in R-21-0040 for family law cases also be adopted. The motion passed unanimously.
