    Would amend ER 1.8 (Rule 42 of the Rules of the Supreme Court of Arizona) to permit a lawyer representing an indigent client to give the client modest gifts for basic living expenses.

    Comments must be submitted by no later than Wednesday, May 1, 2024, and any reply by a petitioner must be submitted no later than Monday, June 3, 2024.

    Many indigent clients lack basic resources. Non-profit law firms are often on the front lines and may be able to help clients avoid utility shut-offs or even eviction. However, rule 1.8 ties the hands of non- profit firms that represent clients on a pro bono basis. These firms have no financial interest, in the litigation, other than seeing a positive outcome for the client. Lawyers in non-profit firms are also “First Responders.” Like police, fire and health workers, they are often in first position to help avert a crisis. Also, these firms are often in a position to receive grant funds for client assistance; however, due to Arizona’s Rule 1.8 e., non-profit law firms decline to be recipients of such funds. Amending the Rule, to bring it in line with the language contained in the ABA Rule, would be beneficial to the public at-large and would also greatly benefit Arizona’s most vulnerable populations.
