This is a proposal to amend Rule 44(a) of the Arizona Rules of Family Law Procedure (ARFLP) to clarify the requirements for applications for default in family court cases.
This petition was not submitted by the January 10, 2020 deadline, because as a member of the Family Court Improvement Committee, I concluded that the underlying issue addressed in this Petition should be addressed by the Committee. Unfortunately, the Committee did not meet until January 13.
I did raise this issue with the members of the Committee. Though, no formal action was taken nor was there a decision made to file this Petition with the Committee being the petitioning party, there was general support for the proposal.
To expedite the court's consideration of this issue, I am filing this as an individual and not as a member of the Committee.
Would amend Family Law Rule 44(A)(2)(E)'s requirements for a proof of service
Filed January 16, 2020.
Comment are due on or before May 1, 2020.
Replies are due on or before June 1, 2020.
ORDERED: Petition to Amend Rule 44(a) of Arizona Rules of Family Law Procedure = ADOPTED as modified, effective January 1, 2021.
