Would adopt a new Rule 37.1 of the Arizona Rules of Family Law Procedure to create a procedure for the appointment of a guardian ad litem in family law proceedings if the court has reason to believe that one of the parties is incapacitated or is an adult in need of protection, amend Rule 37 of the same rules to replace references to a person being “incompetent” to saying that the person is “incapacitated” (along with other changes), amend Rule 3 of the same rules to include additional definitions, and amend Rule 36 of the same rules to alter certain provisions regarding minors and changing “incompetent person” to “incapacitated person or adult in need of protection.”
