    The Family Court Improvement Committee petitions this Court to add Rule 30, Right to timely review, to the Arizona Rules of Family Law Procedure as outlined in Appendix A. This Petition addresses public complaints about delays by family court judges on stipulated or uncontested actions. Upon investigation, the Committee found several areas where the superior court failed to rule promptly.

    Filed: November 28, 2022

    Would adopt a new Rule 30 to the Rules of Family Law Procedure to impose deadlines for judges to enter certain types of rulings or orders.

    Comments must be submitted no later than Monday, May 1, 2023.
    Any reply by a petitioner must be submitted no later than Thursday, June 1, 2023.

    Comments must be submitted no later than October 2, 2023.
    Any reply by a petitioner must be submitted no later than October 16, 2023.

    The Family Bench of the Superior Court in Pima County joins the Maricopa County comment about the proposed ARFLP 30.

    In addition, we note potential ambiguity regarding the triggering event for temporary orders. Specifically, it is unclear whether the ruling/action has to be made after "a hearing" or the "completed hearing." If a judicial officer needs to continue a hearing to take additional evidence, then deadlines should be triggered from the completion of the continued hearing and not from the date of the initial hearing.

    On behalf of the Family Court Improvement Committee, the undersigned replies to comments under Rule 28 of the Arizona Rules of the Supreme Court in response to the Petition to Add Rule 30 to the Arizona Rules of Family Law Procedure. The Family Court Improvement Committee considered the comments from the Maricopa County Superior Court, the Maricopa County Superior Court Clerk, and the Presiding Family Law Judge of Pima County. FCIC agrees with most of the comments. As a result, outlined in Appendix A, the FCIC submits an amended proposal to amend proposed Rule 30 and amendments to Arizona Rules of Family Law Procedure 43.1, 44.1, 45, 47, 47.1, 47.2, 48, and 91.5 as suggested by the comments.
