    Would raise the Standard of Proof in a civil IAH Contested Hearing from "a preponderance of the evidence" to "clear and convincing" evidence.
    Also and informal request to adopt a Rule to set the same standard - or "probable cause" for the ex parte hearing.

    Would amend Rule 38(g), Arizona Rules of Protective Order Procedure, to raise the standard of proof for a protective order to remain in effect from "a preponderance of the evidence" to "clear and convincing evidence."


    Comments must be submitted on or before May 1, 2019.

    Replies must be submitted on or before June 1, 2019.
