    This petition requests emergency adoption of a rule that would require a demand for jury trial, when the right to a jury exists, in probate proceedings concerning guardianships and conservatorships.

    Would preserve the default of no jury trial unless requested in probate guardianship and conservatorship matters, consonant with Title 14, A.R.S.

    Filed: December 3, 2018

    Comments must be submitted on or before May 1, 2019.

    Replies must be submitted on or before June 1, 2019.

    ORDERED: Petition to Adopt Rule 28.2, Arizona Rules of Probate Procedure = EMERGENCY ADOPTION CONTINUED as Rule 28.1 until January 1, 2020, at which time it will be abrogated and replaced by new Rule 29.
