The Petitioner respectfully requests this Court amend Rules 5, 11, and Appendix A of the Arizona Rules of Eviction Procedure. The petition is made on an emergency basis because it is necessary to provide a mechanism to implement A.R.S. § 22-206. The new statue governs remote appearances in residential eviction actions.

    Filed: June 29, 2021

Would amend Rules 5 and 11 and Appendix A of the Arizona Rules of Eviction Procedure to conform the rules and appendix to a recent statutory enactment permitting a party, attorney, or witness to appear remotely at an initial appearance of a special detainer or forcible detainer proceeding using a telephone or video conference connection.

Comments must be submitted on or before Monday, May 2, 2022.
Any reply by a petitioner must be submitted on or before Wednesday, June 1, 2022.

Given the Supreme Court's adoption of R-21-0039, I am authorized to post on behalf of Judge Williams that he agrees that this petition is now moot and may be withdrawn. Thank you for your consideration.
