This petition seeks to change Arizona Rules of Criminal Procedure 32.16(j) and 33.16(j) to clarify that the entire trial court record should be transmitted to the appellate court. Including the entire trial court record in the record on review is essential for the appellate court's consideration of a petition for review and clarifying these rules will reduce delay in the appellate court's consideration of petitions for review in post-conviction relief proceedings.

    Filed: January 6, 2023

Would amend Rules 32.16(j) and 33.16(j) to clarify that when a petition for review is filed challenging an order ruling on a request for post-conviction relief, the superior court must transmit the entire trial court record to the Court of Appeals.

Comments must be submitted no later than Monday, May 1, 2023.
Any reply by a petitioner must be submitted no later than Thursday, June 1, 2023.
