    Petition to Amend Rule 38, Rules of the Supreme Court

    Would permit spouses of military service members temporarily stationed in Arizona who meet specified requirements to apply for admission to the practice of law in this state

    The Court issued the following Order on August 30, 2012:

    IT IS ORDERED that the draft amendment, which is based on the proposal made by the State Bar of Arizona in its comment, shall be opened for comment until November 9, 2012.

    COMMENTS DUE November 9, 2012.

    ADOPTED as modified, effective January 1, 2013.

    I am a military spouse who began my legal education at the University of Arizona, but because of military orders had to complete it in South Carolina. Since completing law school we have been stationed at Ft. Benning, GA and Ft. Lewis, WA. I put off taking the bar exam for a year after law school because of my husband's career. When we get orders to move again I may have to put my legal career on hold because I will not have met the reciprocity requirements at the next duty station. I serve my country along side my husband, keeping the homefront running smoothly so he can serve us over seas. Please consider adopting this rule change to allow military spouses to continue their legal careers as they move with their families.

    Justices of the Supreme Court,

    I have been a Member of the State Bar since 1972 , a partner in Lewis and Roca and in Mariscal Weeks.

    I have a son who is an Honors Graduate of the Barrett Honors College at ASU and who is currently a 1LT Airborne Ranger in the US Army stationed in Ghazni Province in Afghanistan. My son's wife is also a graduate of ASU, a graduate of the U of A Law School ,a Member in good standing of the Arizona State Bar and currently working in Washinton D.C.as an attorney for the Department of Homeland Security.

    Thus I know first hand of the stresses and rigors faced by military spouses that are attorneys trying to practice law, support their miltary spouses and support the efforts of the United States both home and abroad.

    Assuming they are qualifed, attorney spouses of military personel should be afforded every opportunity to practice law where ever the miltary spouse is posted by the Department of the Army.

    I thus support the proposed Rule 38 (j) and ask that the Supreme Court of the State of Arizona adopt the proposed rule as soon as possible.
