    Ballard Spahr LLP supports the the petition to modify the ethical rules on screening and imputation of conflicts (R-13-0046). Ballard Spahr LLP is a national law firm with more than 500 attorneys in 13 offices in 10 states, including our office in Phoenix. We have extensive experience with ER 1.10(d)(1), which informs our position on the proposed modification.

    We believe that eliminating ER 1.10(d)(1) so that a lawyer representing a client in litigation can move (without the client) to the opposing law firm as long as new firm appropriately screens the moving lawyer is necessary and will appropriately bring Arizona’s rule in line with the current Rule 1.10 of the ABA Model Rules of Professional Conduct. We urge the Court to adopt the rule change proposals contained in petition R-13-0046.
