    The proposed rule is intended to remove the unintended punitive effect on respondents of the current rule which requires posting of probation on the State Bar website for five years.

    Filed April 3, 2017

    Comments must be submitted on or before May 21, 2018.
    Reply to the Attorney Regulation Advisory Committee comment on or before July 27, 2018.

    ORDERED: Petition to Amend Rule 49(a)(2)(C)(ii), Rules of the Supreme Court= ADOPTED as modified, effective January 1, 2019.

    Good morning
    I am writing in support of this Petition and agree with the arguments contained therein.
    I am Denise M. Blommel, Bar No. 005388, 7702 E. Doubletree Ranch Road, Suite 300, Scottsdale, AZ 85258, telephone 480-905-5810 and email at [email protected].
    I regularly represent teachers in disciplinary matters before the State Board of Education. It has been my experience that punitive measures can be counterproductive, especially for professionals. It has also been my experience that publication on the Internet results in both instantaneous and permanent information. It is unfair for any professional to be labeled with a pejorative term like "probation" long after the terms of probation have been completed. Certain members of the public use this information to discredit the entire profession.
    The public has every right to be protected from lawyers who violate the rules. On the other hand, lawyers deserve the same standards of fairness as the members of the public. If a lawyer has completed the terms of probation, the lawyer should be treated like any other member of the public who has similarly completed the terms of probation.
    I respectfully request your every consideration to this petition.

    The Court granted the ARC additional time to submit a comment concerning R-17-0035
    after the normal deadline had expired. The ARC’s comment was posted on July 6, 2018.
    This is my request to submit a reply to the Comment posted by the ARC and a request
    for the Court to extend the time for my reply to the ARC’s most recent comment to and including July 27, 2018.
