Amendments to add a requirement that DCS state in its application for court-authorized removal that it has provided information about its investigation and child safety decision-making processes to the parents or guardians from whom it seeks to remove the child, in accordance with SB 1186. Amendments to add judicial determination at the PPH regarding whether an educational placement conference has been conducted in accordance with SB 1205 and whether DCS has informed all parties and participants of their rights under SB 1186.

    Filed: January 9, 2024

Would amend Rules 327 and 332 of the Rules of Procedure for the Juvenile Courts to, among other things, require the Department of Child Safety indicate on its application for court-authorized removal whether it has provided the child’s parents or guardians with information about its investigation and decision-making process.
