 Constitutionality Decision

Rejecting  defendant’s argument that imposition of the death penalty under Arizona’s sentencing statute for felony murder, A.R.S. § 13-751(A)(2), as applied to the facts of this case, violated his due process rights under the Fifth Amendment and article 2, section 4 of the Arizona Constitution and his rights under the Eighth Amendment and article 2, section 15 of the Arizona Constitution.

Holding that budget reconciliation bills HB 2898 (sections 12, 21, and 50); SB 1824 (sections 12 and 13); SB 1825 (section 2); and SB 1819 (sections 4, 5, 33, 35, 39, and 47) violate the “title requirement” of Ariz. Const. art. 4, pt. 2, § 13, and that SB 1819 also violates the “single subject rule” of Ariz. Const. art. 4, pt. 2, § 13.
