The petition proposes amending on an emergency basis Rules 26.10, 26.11, 27.5, 30.1 through 30.6, and 41 of the Rules of Criminal Procedure to implement the recently enacted HB 2119, which allows a person’s civil rights to be restored when certain criteria have been met.  On July 6, 2022, the Court opened this petition for public comment, with comments due no later than October 3, 2022, and any reply due no later than October 17, 2022.  Following the August 2022 Rules Agenda, the Court entered an order continuing the Court’s consideration of the petition. At its December 2022 Rules Agenda, the Court will decide whether to adopt these amendments, or decide whether to adopt them on a permanent basis if they are adopted earlier on an emergency basis.

Following the August 2022 Rules Agenda, the Court entered an order amending on an emergency basis Rules 3.2, 4.2, 7.3, 11.5, 14.4, 39, and 41 of the Rules of Criminal Procedure to implement SB 1075, SB 1602, HB 2709, and HB 2372 from the 2022 legislative session.  On June 29, 2022, the Court opened the petition for public comment, with comments due no later than October 3, 2022, and any reply due no later than October 17, 2022. The Court will decide whether to adopt these amendments to the rules and forms on a permanent basis at its December 2022 Rules Agenda.

Order amending Rules 18.4 and 18.5 of the Rules of Criminal Procedure, and Rule 47(e) of the Rules of Civil Procedure 47(e) (and related comments) by eliminating peremptory challenges in jury selection in criminal and civil trials, effective January 1, 2022.  The amendments apply only to jury selection that occurs after January 1, 2022.  The order further requests the Task Force on Jury Data, Collection, Practices, and Procedures to consider whether the criminal or civil rules should be expanded or otherwise modified with respect to for-cause challenges to accommodate the abolition of peremptory strikes. The Task Force is requested to propose any needed revisions by November 1, 2021.
