Order adopting on an emergency basis Rule 123(d)(7) of the Rules of the Supreme Court of Arizona to establish provisions for restricting public access in cases opened under A.R.S. Title 36, Chapter 40 involving defendants who have been involuntarily committed after a finding of incompetence and being dangerous under newly enacted A.R.S. § 13-4521, effective January 1, 2024. The Court further ordered that it will decide whether to adopt the rule amendments on a permanent basis during its August 2024 Rules Agenda and reopened the petition for public comment, with all comments due no later than May 1, 2024, and any reply due no later than June 3, 2024.

Following the August 2022 Rules Agenda, the Court entered an order amending on an emergency basis Rules 30 and 123 of the Rules of the Supreme Court of Arizona to implement statutes enacted in the 2021 and 2022 legislative sessions. On July 25, 2022, the Court opened the petition for public comments, with comments due no later than October 3, 2022, and any reply due no later than October 17, 2022.  The Court will decide whether to adopt these rule amendments on a permanent basis at its December 2022 Rules Agenda.

Following the August 2022 Rules Agenda, the Court entered an order amending on an emergency basis Rule 60 of the Rules of the Supreme Court of Arizona to provide that a prevailing respondent in a State Bar disciplinary proceeding may recover attorney fees and costs in certain circumstances.  On July 18, 2022, the Court opened the petition for public comment, with comments due no later than October 3, 2022, and any reply due no later than October 17, 2022. The Court will decide whether to adopt these rule amendments on a permanent basis at its December 2022 Rules Agenda.

Rule 123, Rules of the Supreme Court, and Promulgating New Rules 5(f), Arizona Rules of Civil Procedure, and Rule 1.8, Arizona Rules of Criminal Procedure.

IT IS ORDERED vacating the Court's order dated June 6, 2005, amending Rule 123, Rules of the Supreme Court, Rule 5(f), Arizona Rules of civil Procedure, and Rule 1.8, Arizona Rules of Criminal Procedure. Although the Court approves of the concept as set forth in the petition and the previously adopted amendments, it is necessary to postpone the effective date of December 1, 2005, to permit efficient and effective implementation of the provisions therein. IT IS FURTHER ORDERED that the Administrative Office of the Courts, working with Court administrators and clerks of court, shall continue to work on finding solutions for the problems encountered, and that such group shall report to the court on its progress on or before June 1, 2006.

Effective Date Vacated.
